In the initial investigation, the Pueblo Police Department (PPD) said they were sent out to the Days Inn on North Elizabeth Street around 6:30 p.m. on February 7 after receiving reports that shots were fired at the hotel.

PPD says when they arrived, they found a man later identified as James Herbert dead. According to officials, an investigation revealed that shots were fired during an argument that had escalated, and McKenney was then arrested on first-degree murder charges.

The DA's office says McKenney's sentencing will be held on November 10 in Division 503. According to officials, under state law, a conviction of murder in the first degree carries a mandatory sentence of life in prison without the possibility of parole.
